Nowadays, with the effect of the increasing foreign population, many foreigners have begun to be adopted by Turkish citizens. In case the adoption practice meets some conditions, it has become possible for the foreigners who have been adopted to have Turkish citizenship.
Adoption of a foreign spouse’s child
Adoption legally starts with the adoption application of the Turkish spouse for the child in the custody of the foreign spouse. Following Article 306 of the Turkish Civil Code, the condition that the couple has a marriage of at least two years or the spouse requesting adoption must be over thirty years old.
If these conditions are not met, the adoption application will be deemed invalid. In addition, there should not be any legal obstacle for the adoptive person to have the capacity to adopt and for the person to be adopted to live in the Republic of Turkey.
The acquisition of Turkish Citizenship by the people who were adopted
If Turkish citizens adopt a foreign national or stateless child, it is possible to transfer to Turkish Citizenship if the adopted child has certain conditions.
First of all, the child to be adopted must not have reached the age of 18 yet. If the persons to be adopted are over the age of 18 as of the date of application, if the foreigner stays uninterrupted for 5 years with a residence permit following the law, Turkish Citizenship can be acquired with the decision of the competent authority.
